iPad is Legal Owned by China Company

Apple loses the right to use the ‘iPad’ name in China. China court stated that the trademark is the legal property of the company from Shenzen, China, Proview International.

“IPad trademark dispute between Apple and Proview is entering the legal process,” said Yan Xiaohong, Deputy Director of the National Copyright Administration of China about iPad is Legal Owned by China Company.

As quoted by Reuters on Wednesday (4/25/2012) Yan came respond to the news iPad is Legal Owned by China Company that the high court in Guangdong in the process of resolution of the trademark. But he added, by the China rule of law, Proview is a representative and legitimate users of iPad trademark.

Copyright infringement cases of iPad name is quite serious. In February, authorities in China began a foreclosure Apple iPad after Apple declared it lost the initial court ruling against Proview Technology.

Apple spokeswoman Carolyn Wu declined to comment further detail. Did he not mention the possibility Apple will appeal. Apple also reiterated their previous statement that they would never violate the trademark of another company.

Apple then offers a peaceful settlement in its dispute with the Proview Technology with related to ‘iPad’ trademark in China. Both are still negotiating about the price to be paid by Apple to use the brand that became the property of the Proview.

As is known, Proview, based in Shenzhen, China iPad registered trademark in many countries in 2000. Apple and bought the trademark rights of a subsidiary of Proview in Taiwan in 2009.

However, the Proview claimed iPad is Legal Owned by China Company, sale and purchase agreement does not include the right to use the trademark ‘iPad’ in China. This then becomes a problem between them.
